Changes to Employment Standards PLEASE NOTE! Effective immediately, comprehensive changes to The Employment Standards Code and the Construction Industry Wages Act will affect all Manitoba construction industry employers. Highlights of What's New in 2007: Termination of Employment - Employers are no longer allowed to set an alternate notice policy. After 30 days of employment, both employees and employers must provide notice. The amount of notice depends on the number of years employees have worked. Changes to Termination of Employment Fact Sheet Holiday Pay - Improved statutory holiday pay provisions for part-time workers. Work on a general holiday is paid at overtime rates, plus employee is entitled to holiday pay for the day. Vacation and Vacation Pay Fact Sheet Unpaid Leave - Three days of unpaid leave for bereavement days, three unpaid days for illness or to deal with the needs of family. The definition of family member has been expanded to include extended family. Overtime - Exemptions from hours of work and overtime for employees who earn a minimum annual amount and exercise substantial control over their work schedule; improving overtime pay provisions for incentive-based workers. Employers are obliged to keep records of all overtime hours. These overtime hours attract pay at 1 1/2 times regular hourly wage. Overtime for Incentive Pay Fact Sheet Young Employees - New criteria for employees under 16 years old: They must have a permit from the Employment Standards Branch before they begin their jobs, they cannot work more than 20 hours during a week of school, and they cannot work from 11 p.m. to 6 a.m. in any industry. Also, employees under 16 are not allowed to work at construction sites, on drilling or servicing rigs, on swing stages or scaffolds, in industrial or manufacturing processes or pruning, repairing, maintaining, or removal of trees. Employees under 18 years old cannot work alone from 11 p.m. to 6 a.m. This criteria also prohibits employees under the age of 18 from working in higher-risk industries. Deductions From Wages - Employers cannot deduct wages from an employee where there is no direct benefit to the employee. (i.e. damage, lost items, photo radar, etc.) Deductions From Wages Fact Sheet Recovery From Employees Summary Reporting Pay - Guaranteeing employees who report for work minimum pay of three hours or pay for the regularly scheduled shift. Eastern Manitoba Career Symposium Winnipeg Construction Association seized the opportunity to educate students about careers in skilled trades at the first annual Eastern Manitoba Career Symposium. Held in Beausejour, MB, on May 7 & 8, 2007, the event attracted a host of schools from the Sunrise School Division and offered informative displays and speaker sessions. WCA’s interactive Explore Your Future in Skilled Trades booth encouraged students and adults to discover the many career prospects in construction. A laptop with a large flatscreen TV attracted curiosity and allowed attendees to search through the Trade Up! CD and play a challenging construction game.
