In addition to Vacation Pay (4% for the first 5 years of employment and then 6% thereafter), the Employment Standards Code requires construction industry employers to pay 4% of an employee’s non-overtime wages as General Holiday Pay. This is to cover ten (10) General Holidays throughout the year. There are only seven (7) days actually listed in the Code with three (3) “other” days to be given. This requirement in the Code did not change when the Province added Louis Riel Day. In fact, Louis Riel Day becomes the eighth (8) named day and leaves two (2) “other” days to be given. To calculate the combined benefit, many construction employers multiply gross pay by 8.16% to calculate Vacation Pay and General (statutory) Holiday Pay. Will the addition of the new Louis Riel Day, which is a statutory general holiday, change the 4% calculation (and the 8.16% figure)? The answer is “No and Maybe” depending on the circumstances. There is, however, a risk where contractors have instituted conditions of employment linking the 4% payment to a specific number of holidays (both general statutory holidays and other non-statutory holidays such as August Civic holiday and Boxing Day) that an employee may claim that there is additional compensation required for Louis Riel Day. Whether or not a contractor is at risk is an individual analysis that needs to be considered with your professional advisors. In summary, it is doubtful that contractors have to pay more than 4% general stat pay, even with the addition of Louis Riel Day. Whether a contractor has a further obligation will depend on the terms of employment between the individual contractor and their construction employees. Together with Sisler High School, the Winnipeg Construction Association is coordinating a hands-on Construction Career Day for 15 classes of Grade 9 students at Winnipeg’s Sisler High School. In one morning, students will learn about Manitoba’s current construction climate and the many career opportunities available in Manitoba’s non-residential construction industry. At each display station, students will learn about a particular trade, how to become a qualified tradesperson, benefits of the job, view demonstrations and even try their hand at a few trades.
